New EU regulations | Enforced on December 13, 2024, issued by the EU (GPSR)

The General Product Safety Regulation (GPSR) was published in the Official Journal of the European Union on 23 May 2023 and will come into force on 13 December 2024, It will replace the current General Product Safety Directive (GPSD) and the Limitation Foods Directive. The GPSR is a new key instrument in the EU’s legal framework for product safety, requiring all consumer products on the EU market to be safe and placing specific obligations on companies to ensure safety.

What scope does GPSR affect?

Most sellers exporting to Europe will be affected by this regulation. If you meet both of the following points, you will need to complete the compliance requirements of this regulation before December 13, 2024 (local time):

1. Selling goods in the EU and Northern Ireland;

2. Selling non-food consumer goods.

The following product types are excluded:

 Medicinal products for human or veterinary use;

 Foodstuffs;            

 Animal feed;

 Living plants and animals;

 Animal by-products and derivatives;

 Plant protection products (e.g. pesticides);

 Consumer's riding or mobility equipment, provided that the equipment is operated directly by the service provider within the scope of the transportation service provided to the consumer and not by the consumer himself;

 Aircraft;

 Antiques.

What new requirements does GPSR place on manufacturers?

一. Provide EU-responsible person for the goods sold:

The following persons can be EU-responsible persons:

① Manufacturers registered in the EU;

② Importers registered in the EU;

③ Authorized representatives of companies registered in the EU, designated as responsible persons in writing by the manufacturer or brand;

④ Delivery service providers registered in the EU who are responsible for delivering goods.

二. Make sure that product labels include the following information:

① Contact information of the EU-responsible person (postal address and email address/URL);

② Warning and safety information (please use the language of the country/region of sale);

③ Labels of product type, batch or serial number, or other elements;

④ Name, registered trade name, registered trademark, postal address and email address/URL of the manufacturer and importer (if applicable), and the postal address or email address/URL of a single point of contact who can contact them (if different from the above address)


How to designate an EU authorized representative?

1. The product testing laboratory or certification company (such as ASTC) you use may provide EU-responsible person services.

2. You can use listed third-party providers (such as ASTC) in the Amazon Service Provider Network (SPN).
